These Terms of Service govern your use of the Melvado website and purchases made through it. The store is operated by Melvado.

By using our website or placing an order, you agree to these Terms of Service. Nothing in these Terms limits any consumer rights that cannot lawfully be excluded, including your rights under applicable UK consumer law.

Store use

You may use our store only for lawful purposes.

You must not:

• interfere with the security or proper operation of the website;

• introduce viruses, malicious code or other harmful material;

• misuse another person's personal information;

• attempt fraudulent transactions;

• infringe intellectual property rights; or

• use our store in a way that violates applicable laws or regulations.

We reserve the right to suspend or refuse access where we reasonably believe the website is being misused.

Product information

We aim to describe and display our products as accurately as possible. Product photographs are provided for illustrative purposes. Screen settings, lighting and photography may cause minor differences in colour or appearance.

Product measurements are approximate unless stated otherwise.

Products supplied to consumers must be as described, of satisfactory quality and fit for any purpose made known to us. Nothing in our product descriptions limits these statutory requirements.

Prices and taxes

Prices are displayed in pounds sterling and include applicable taxes unless clearly stated otherwise.

Delivery charges, if applicable, will be shown before you complete payment.

We may change product prices at any time. Price changes will not affect an order that has already been accepted.

If a pricing or product information error is obvious and could reasonably have been recognised as an error, we may contact you before accepting or fulfilling the order. You may confirm the order at the correct price or cancel it for a full refund.

Orders and contract formation

Submitting an order is an offer to purchase products from Melvado.

After submitting an order, you will receive an order acknowledgement. This acknowledgement does not necessarily mean that your order has been accepted.

A contract is formed when we send confirmation that your order has been accepted or dispatched, depending on the wording of the confirmation.

We may refuse or cancel an order for legitimate reasons, including:

• suspected fraud;

• payment failure;

• product unavailability;

• legal or delivery restrictions;

• incorrect customer information; or

• an obvious pricing or product information error.

If payment has already been taken for an order that we cancel, we will issue a refund.

You are responsible for providing complete and accurate billing, delivery and contact information. You should contact us promptly if you notice an error.

Payments

Available payment methods are displayed during checkout.

Payments may be processed by Shopify Payments or another payment provider displayed at checkout. By placing an order, you authorise the applicable payment provider to charge the total amount shown during checkout.

We do not normally receive or store complete payment card details.

Delivery and risk

Delivery options, charges and estimated delivery times are described in our Shipping Policy and displayed during checkout.

Risk of loss or damage remains with Melvado until the products come into your physical possession or the physical possession of a person nominated by you, other than the delivery carrier.

Cancellations, returns and refunds

Your cancellation, return and refund rights are explained in our Returns and Refunds Policy.

These rights include any mandatory rights available under applicable consumer law. Our policies do not limit or replace those rights.

Promotions and discount codes

Promotions and discount codes may be subject to additional conditions displayed with the relevant offer.

Unless stated otherwise:

• discount codes cannot be exchanged for cash;

• discount codes cannot be applied after an order has been completed;

• only one discount code may be used per order; and

• discount codes must be used before their stated expiry date.

We may withdraw or refuse a promotion where it has been misused, obtained fraudulently or applied due to an obvious technical error.

All reference prices, discounts, stock messages, countdowns, customer counts, reviews and delivery claims displayed by Melvado must be accurate and must not be misleading.

Reviews and user content

If you submit a review or other content, it must:

• reflect your genuine experience;

• not contain false or misleading information;

• not be unlawful, abusive or discriminatory;

• not infringe another person's rights; and

• not contain malicious software or unsolicited advertising.

You give us permission to display and reproduce submitted content for store and marketing purposes, subject to applicable privacy and consumer laws.

We do not pay customers to leave positive reviews or remove genuine negative reviews solely because they are negative.

Intellectual property

The Melvado name, website design, written content, graphics, photographs and other materials are owned by or licensed to us and are protected by applicable intellectual property laws.

You may use our website for personal shopping purposes. You may not reproduce, distribute, commercially exploit or create derivative materials from our content without prior written permission.

Third-party services

Our store may contain links to or integrations with third parties, including payment providers, delivery companies and social media platforms.

Those third parties may have their own terms and privacy notices.

We are not responsible for unrelated third-party websites that we do not control. This does not affect our responsibility for service providers we use to fulfil our contract with you.

Liability

We do not exclude or limit liability where doing so would be unlawful. This includes liability for:

• death or personal injury caused by negligence;

• fraud or fraudulent misrepresentation;

• breach of mandatory consumer rights; and

• defective products where liability cannot legally be excluded.

If you are purchasing as a consumer, we are responsible for reasonably foreseeable loss or damage caused by our breach of these Terms or our failure to use reasonable care and skill.

We are not responsible for business losses arising from a consumer purchase or losses that were not reasonably foreseeable, except where applicable law provides otherwise.

Events outside our reasonable control

We are not responsible for delays caused by events outside our reasonable control.

If such an event occurs, we will take reasonable steps to minimise its effects, keep you informed where appropriate and fulfil our obligations as soon as reasonably possible.

Your legal rights relating to material delays remain unaffected.

Severability

If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply.

No waiver

If we delay enforcing a right or provision, this does not mean that we waive that right or provision.

Governing law and disputes

These Terms are governed by French law.

If you are a consumer in the United Kingdom, this choice does not deprive you of mandatory protections available under the law of the part of the United Kingdom in which you live.

You may bring proceedings in any court available to you under applicable consumer law.

Changes to these Terms

We may update these Terms from time to time.

The Terms that applied when your order was accepted will continue to govern that order unless a change is required by law or agreed with you.
